Your Rights & How to File a Complaint with the BBS

Pursuant to California Business & Professions Code §§ 4980–4989.2 and BBS regulations

Your Rights as a Client

  • Receive a copy of your clinical records upon written request (Health & Safety Code §123111)
  • Request amendment of records you believe are inaccurate
  • Refuse or discontinue treatment at any time without penalty
  • Ask questions about your diagnosis, treatment plan, and progress
  • Receive a referral to another provider upon request
  • Request an accounting of disclosures of your protected health information (HIPAA 45 CFR §164.528)
  • Receive a Notice of Privacy Practices before your first session
  • File a complaint if you believe your rights have been violated

How to File a Complaint

If you believe your therapist has acted unethically or violated California law, you have the right to file a complaint with the California Board of Behavioral Sciences (BBS) — the state agency that licenses and regulates LCSWs, MFTs, and other behavioral health professionals.
